Challenge to validity of Parliament Act 1949

30.56In 2004 supporters of hunting with dogs took legal action to challenge the validity of the Hunting Act 2004 (which had been passed under the Parliament Acts) on the ground that the 1949 Act was itself invalid as being ultra vires the 1911 Act. Whilst on appeal to the House of Lords the case was dismissed and the validity of the 1949 Act thereby affirmed, the courts were nevertheless prepared to consider the validity of an Act of Parliament passed according to statutory process (see paras 16.21–16.22 ).1
